Terms & Conditions – Chateau Marmont

These Terms & Conditions ("Terms") govern and apply to all accepted bookings made with the Chateau Marmont (including via our website, over the phone, by email, or in person). By making a booking with us, you confirm your acceptance of these Terms. A contract between you and us comes into effect once we accept your booking and send confirmation by email or another form of communication.
1. Information About Chateau Marmont
- Chateau Marmont is owned and operated by Chateau Holdings, LTD ("Chateau Marmont", "Hotel", "we", "us", or "our").

2. Definitions

For purposes of these Terms:
- Booking means any reservation for accommodation, dining, or other services.
- Website means https://www.chateaumarmont.com/
- You or Your means the guest receiving accommodation or services, including members of your party.
3. Bookings
- You must be at least 18 years old to make a booking.
- A valid credit card is required to guarantee all reservations.
- If payment has not been made in advance, all charges are due upon departure.
- Guests must present valid government-issued photo identification that matches the payment card used for the reservation.
- We may authorize your payment card to cover incidentals or the full booking amount.
- Card authorizations are normally released within 72 hours of checkout, subject to your card issuer.
- Bookings may not be transferred without our written consent.
- We reserve the right to change room allocations during your stay.
4. Room Prices
- Rates are subject to change until a booking is confirmed.
- Rates exclude meals and other extras unless otherwise stated.
- Applicable taxes are included unless otherwise specified.
- Rates are based on your arrival date and length of stay. Early departures may result in a rate adjustment.
5. Check-In & Check-Out

Check-in begins at 4:00 PM.
Check-out is by 11:00 AM.
Guests departing early should notify the hotel in advance to avoid one night's room charge.
Late checkout is subject to availability and may incur charges:
- 2:00 PM – 5:00 PM: Half-day rate
- After 5:00 PM: Full nightly rate
6. Cancellation by You
- Changes or cancellations must be made by email or telephone.

Cancellation deadlines:
- Rooms: 48 hours before arrival (12:00 PM PST)
- Suites: 72 hours before arrival (12:00 PM PST)
- Dining: 24 hours before reservation (12:00 PM PST)
7. Cancellation by Us
- We reserve the right to cancel or modify reservations resulting from fraud, booking errors, or violations of these Terms.

We may also cancel reservations because of events beyond our reasonable control,
including but not limited to:
- Fire
- Flood
- Government action
- War or civil unrest
- Terrorism
- Embargo
- Severe weather
- Labor strikes
- Pandemics or public health emergencies

If cancellation occurs under these circumstances:
- Unused prepaid nights will be refunded.
- Unpaid reservations will not be charged.
- No additional compensation will be provided.
8. Behavior & Conduct
- Guests are expected to treat hotel staff, guests, and property respectfully.
- Commercial photography, filming, livestreaming, influencer content, and other monetized content are prohibited without prior written approval.

Violations may result in:
- Cancellation without refund
- Removal from the property
- Future booking restrictions
- Denial of entry to affiliated hotels
9. Damage
- Smoking is prohibited except in designated areas.
- Guests are responsible for any damage caused by themselves or members of their party, including repair, replacement, cleaning, or smoke damage.
10. Families & Occupancy
- Cribs and rollaway beds are available upon request, subject to room type and availability.
- Guests may not exceed the maximum occupancy for their room unless approved by the hotel.
11. Pets
- Pets are welcome. Guests must notify the hotel in advance and sign a pet waiver upon arrival.
12. Limitation of Liability
- Nothing in these Terms limits liability where prohibited by law.
- The hotel is not responsible for lost personal belongings.

The hotel is not liable for:
- Illness or injury
- Medical expenses
- Loss of profits or revenue
- Business interruption
- Indirect or consequential damages
- Except where prohibited by law, our maximum liability shall not exceed the amount paid for the booking.
13. Pandemic Risk Waiver
By checking into the hotel or using our services, you acknowledge the inherent risks associated with COVID-19 and similar illnesses and agree to release Chateau Marmont from liability to the fullest extent permitted by applicable law, except in cases of gross negligence or intentional misconduct.
14. No Implied Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of future enforcement.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
16. Governing Law & Arbitration
- These Terms are governed by the laws of the State of California.
- Disputes shall be resolved through confidential, binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association.
- Arbitration decisions are final and enforceable by any court with proper jurisdiction.
- Either party may seek temporary injunctive relief from a court where permitted by law.
- Arbitration proceedings remain confidential, except where disclosure is required by law.
- Guests waive any right to participate in class actions and agree that arbitration shall proceed on an individual basis only.
